H1 221g – Fingerprint clearance – Name clearance – Complications

Hi,

Let me explain my case

1. I already have a B1/B2 for 10 yrs

I had 2 petitions from 2 different employers.

Mumbai Consulate:
I went for the interview with employer A’s petition on last week of August. The VO checked something in the computer and gave me a 221g, and asked for fingerprints clearance[all 10 fingers]. After a long wait[which seemed eternal wait] which was 3 months, they called me for an interview. I went hoping to get it stamped finally on First week of December. But the VO again looked into the computer and said my name is a common name and would require a clearance on that [Mohamed I guess].

Now in the meantime my current employer[employer B], was insisting on getting my H1 stamped. The current employer does not know about my ‘petition A. I tried delaying it as much as possible, but on insistence from my employerB, I applied to the consulate with petition B.

I went to the interview with petition B on the first week of Jan. Now the VO[same person], looked into my previous case. He told me the clearances are not yet come. Pls be patient, we will call you up. Even though he accepted my petition B.

My questions:
1. Has anyone come across a case like mine, pls let me know.
2. Can I travel on my B1 even though my H1 is on pending.
3. What is the usual time taken for Name clearance.
4. What are the chances of getting a VISA [difficult one]

Pls reply.
Also it is nearly 6months since I have applied and have put everything on hold because of this.
Frustrated me.

adminprocessing

hi crakpot,
when did u went for stamping,at that time did vo give u blueform stating that "we will contact u after adminprocessing has been completed".after 3 months did they call u or send any letter to ur home.and what did they inform u.
i went for h4 they gived me adminstrative processing,5days less 3 months over.will they give response,if in ur case also vo gived u adminproceesing and has given u response then i will hope for response from the consulate for my visa thatswhy iam asking .iam getting worried will they do adminprocessing or not.

Hi Bunny,

Both the times I was given the 221g form[White], one for fingerprinting and after three months for Name clearance. They called me on my Cell phone and told me that the clearance has come pls come on any working day to the consulate for an interview.

Can anyone pls answer my queries mentioned
1. Has anyone come across a case like mine, pls let me know.
2. Can I travel on my B1 even though my H1 is on pending.[???]

thanks for ur reply,so they are not issued adminprocessing to u.u wrote that u went second time with h1 petitionb papers. what did u mean by "eventhough vo accepted my petition b".so why he didn't issue ur visa.is first one h1 pending is effected to petition b's h1.my husband changed to direct company ,when he was working in consultancy i got 221(g)adminprocess.so we want to take again h4 appointment with my husband's new h1transfer papers.so we are in dilema,will they ask for my previous case or not.at last what did he told about ur b's petition. did he see petitionb's papers.pls tell me clearly what vo told to u.did he tell to u wait for first h1's query clearence.

Hi Bunny,

From what I understand the petitions are different from Clearances. Even though I applied with my petition B. Since the case is pending he just stamped it 221g again. And asked me to wait. Always at a time only one petition will get accepted. I case would go as changed employer. The A gets nulled I guess.

thanks for ur replies.so u mean that vo accepted ur b's petition and on the basis of b's petition only he has given 221(g) again for name clearance.am i correct.if i went with new h1transfer papers will they accept it,if new papers everything is good then will they give visa or they tell to wait for first h4 adminprocessing .or first h4 will go null and will they take consider new h4 only.please give me ur openion on this .

Same thing[Admin Processing] happened to me

Hi Crackpot
Same thing happeded to me. I appeared for H1-B visa stamping at New Delhi in January, and the vo looked into the computer and said that I have to wait for Admin Processing because of my name, though he accepted the petition.

Does anyone knows, how much time the 'Name Clearance Admin Processing' takes?

you cannot travel on your B-1 visa

Hey crackpot,
I duno the anwer to the remainder of your questions. But this I know for sure, once your H-1b petition is approved, your B-1 visa is null and void. You canot travel on it.

Hi Bunny,

Even though he accepted my B petition, he put me on hold because of A itself I guess. Because he told me that your case will again go on pending because of 'Name clearance'.
I guess everytime you give a new application it will be taken as fresh case unless you have a pending[on hold awaiting clearances]case.

I know I am not aswering the origial query and am sorry for that, but my case seems to be same as yours, so would be very helpful if you can reply back.

Could somebody tell me if its ok to get new H1 petitons filed from 2 prospective employers. Its like I am here in India, and two different employers have proposed to file the petitons for 2006 qouta.

Would both of my petiton will get approved? And how to manage stamping for the same?

Hi There

YEs it is fine to file two petitions,Also you can have two interviews for two petitions. But the last one will be taken as the effective one, the case will go as you have changed employers. You can have only one visa.

Finally After 10 months of loooooooooooooong and Agonising wait...I got my H1 stamped.

So guys out there.....Patience is the only key.........

Wait wait and wait and again wait......You will get yours too.,.,
I have waited 10 patient months....you can imagine...
don't get dishartened by the time delay.....you will get it.....

Hi Crakpot,

After hearing your case I am both happy and frightened at the same time.
Happy that people do get their H1b after a long wait and frightened because people have to wait for so long. You know what I mean.

Its 3 months for me already, and I haven't heard from the London Embassy so far. Mine's a employer check because my employer is a small NJ-based desi consulting firm and I'll be working for their client. Its a typical case.

I am originally from Mumbai and my student visas were denied twice in 2003 because of which I came to UK for my Masters. I currently working here for an American Bank.

Can you throw some light to relieve me from this agonising situation.
